1. Scope and contracting party
These Terms of Use ("Terms") govern access to and use of the website located at thepeptide.clinic and any related pages, services, ordering tools, account areas, and communications made available through that website (the "Website").
The Website is operated for product supply purposes by The Peptide Clinic ("Company", "we", "our", or "us"). The Peptide Clinic is the supplier and contracting party for products offered through the Website.
By accessing the Website, creating an account, submitting information through the gate flow, placing an order, or otherwise using the Website, you agree to these Terms and to the active versions of our Privacy Policy and Medical Disclaimer.
If you do not agree, do not use the Website.
2. Research-use-only platform
The Website is a restricted access research supply platform.
Products made available through the Website are offered strictly for legitimate laboratory or analytical research purposes, subject to applicable law and our approval procedures.
Unless a product page expressly states otherwise in writing, products offered through the Website are:
- not approved medicines
- not dietary supplements
- not food products
- not intended for human consumption
- not intended for diagnosis, cure, mitigation, treatment, or prevention of disease
Catalog access is not public. To access restricted areas, a user may be required to:
- create an account
- provide accurate onboarding details
- accept the active legal documents
- confirm the research-use declaration
- receive manual approval from the Company
We may deny, limit, suspend, or revoke access at any time where we identify fraud risk, regulatory risk, account misuse, inaccurate information, suspected non-research use, or any other risk we consider material.

The Website does not provide medical advice, treatment guidance, prescribing guidance, or therapeutic recommendations.
You are solely responsible for determining whether a product may lawfully be possessed, imported, exported, transported, stored, tested, or used in your jurisdiction and in your specific research setting.
Any references to scientific literature, laboratory context, handling conditions, or possible areas of study are provided without warranty and do not create any representation that a product is safe, effective, approved, or suitable for any particular purpose.
6. Orders and contract formation
Any product listing or catalog access is an invitation to treat and not a binding offer by the Company.
When you place an order, you submit an offer to purchase. An order becomes binding on us only when all of the following have occurred:
- the order has passed our approval and fraud checks
- payment has been successfully authorised or captured by the payment processor
- we issue an order confirmation or otherwise accept the order
We may reject, cancel, hold, or reverse any order before dispatch where we identify stock issues, pricing errors, fraud indicators, compliance concerns, courier limitations, or suspected misuse.
Electronic communications, records, consents, and confirmations may be used to evidence transactions and notices to the extent permitted by applicable law, including the Electronic Communications and Transactions Act 25 of 2002 where relevant.
7. Pricing, payment, and fraud controls
Prices, currency, shipping charges, and any optional fees displayed on the Website are subject to change without notice before order acceptance.
Payment methods currently accepted on the Website are limited to card payments processed through an external payment processor.
We do not guarantee uninterrupted availability of any payment processor, banking rail, or card network.
To manage chargeback, fraud, and compliance risk, we may:
- delay fulfilment pending review
- request additional confirmation reasonably related to the transaction
- cancel or refund flagged orders
- refuse future transactions from accounts or cards associated with elevated risk
- retain transaction, device, communications, and audit information relevant to risk review
If a cardholder disputes a charge without first contacting us where a direct resolution was reasonably available, we may treat that conduct as a breach of these Terms, subject always to any rights the cardholder cannot lawfully waive.
8. Shipping, title, risk, and customs
Unless otherwise stated at checkout, orders are dispatched from South Africa and may be shipped using The Courier Guy or another nominated logistics provider.
Optional shipping insurance, where offered, is provided by the relevant courier or logistics partner and remains subject to that provider's own terms.
Estimated delivery times are indicative only and are not guaranteed.
You are responsible for:
- providing a complete and accurate delivery address
- ensuring that receipt of the goods is lawful in the destination jurisdiction
- paying any import duties, taxes, clearance costs, brokerage fees, or similar destination charges unless we expressly state otherwise
Title and risk transfer are interpreted subject to the mandatory law applicable to the transaction. As a general operational rule, once a compliant shipment has been handed to the nominated courier with the correct order details, transit handling becomes the courier's responsibility. This does not exclude any non-excludable statutory rights that may apply.
We are not responsible for delays caused by customs holds, border controls, local import restrictions, force majeure events, payment review delays, or courier disruptions outside our reasonable control.
9. Returns, replacements, refunds, and chargebacks
Because of the sensitive and restricted-use nature of research products, we generally do not accept returns of:
- opened items
- used items
- tampered items
- temperature-compromised items
- items stored or handled outside stated conditions
- products returned without prior written approval
If you receive the wrong product or a shipment that is visibly damaged on arrival, you must notify us promptly and, where reasonably possible, within 48 hours of delivery, together with sufficient evidence for assessment.
Where we confirm a mis-shipment or verified transit damage, we may offer a replacement, store credit, or another remedy we consider appropriate. Refunds are not guaranteed except where required by law.
Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other mandatory law.
We reserve the right to investigate suspected refund abuse, false loss claims, replacement abuse, or chargeback fraud and to suspend accounts during that process.
10. Acceptable use
You may not use the Website to:
- violate any law, regulation, sanctions rule, or court order
- misrepresent your identity, institution, authority, or intended use
- attempt to gain unauthorised access to restricted systems, data, or accounts
- scrape, harvest, mirror, or systematically extract Website content without our written consent
- interfere with security, rate limits, fraud controls, or technical protections
- upload or transmit malicious code, harmful scripts, or disruptive content
- use the Website in connection with human administration, clinical use, or any prohibited end use
We may investigate and act on any suspected misuse, including disclosure to payment processors, advisers, or authorities where reasonably necessary.
11. Intellectual property
All Website content, branding, page layouts, product data compilations, text, graphics, software, and related materials are owned by or licensed to the Company or its licensors and are protected by applicable intellectual property laws.

- courier delay, customs seizure, or destination-country enforcement action

Nothing in these Terms excludes liability or rights that cannot lawfully be excluded or limited.
13. Indemnity
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, employees, contractors, advisers, logistics partners, payment processors, and technology providers from and against claims, losses, liabilities, damages, penalties, and expenses arising out of or related to:
- your breach of these Terms
- your unlawful, negligent, or prohibited use of products
- your violation of applicable import, export, consumer, safety, or research rules
- your misuse of the Website or account credentials
- third-party claims arising from your possession, handling, storage, testing, transfer, or downstream use of products
This indemnity applies only to the extent permitted by law.
14. Suspension and termination
We may suspend, restrict, or terminate your access immediately if:
- you breach these Terms
- a payment is reversed, disputed, or flagged as fraudulent
- we suspect non-research use or regulatory misuse
- a regulator, payment processor, logistics provider, or legal adviser requires restriction
- continued service presents material legal, operational, or reputational risk
Termination or suspension does not affect rights and obligations accrued before the effective date of that action.
15. Governing law and dispute handling
These Terms are governed by the laws of South Africa.
Before starting formal proceedings, you agree to raise the issue with us in writing at support@thepeptide.clinic and give us a reasonable opportunity to investigate and respond.
If a dispute is not resolved informally, the dispute may be referred to the courts of South Africa or another forum that mandatory law requires or permits.
16. Changes to these Terms
We may update these Terms from time to time. The current version displayed on the Website is the operative version from the date it is published.
Where required by our onboarding flow or by law, continued access may require renewed acceptance of an updated legal document.
